Atiku Petitions Supreme Court To Remove Tinubu On 35 Grounds

The Presidential Candidate of the Peoples Democratic Party (PDP) in the February 25th, 2023 Election, Alhaji Atiku Abubakar, has approached the Supreme Court seeking a nullification of the Presidential Election Petition Court’s judgement.

In his Notice of Appeal, he outlined 35 grounds, upon which he concluded that the Presidential Election Petition Tribunal, in its judgment, delivered by Justice Haruna Simon Tsammani, “committed grave error and miscarriage of justice in its findings and conclusion in his petition that challenged Independent National Electoral Commission’s declaration of Alhaji Tinubu as Nigerian elected President.

Atiku’s Notice of Appeal was filed by his lead counsel, Chief Chris Uche, SAN.

NewsOrient gathered that part of Atiku’s prayers to the Supreme Court include: to set aside the whole findings and conclusions of the Presidential Election Petition Tribunal on the grounds that they did not represent the true picture of the grounds of his petition.

Also, he said the tribunal “erred in law when it failed to nullify the presidential election held on February 25, 2023, on the grounds of non-compliance with the Electoral Act, 2022, when by evidence before the tribunal, INEC conducted the election based on grave and gross misrepresentation contrary to the principles of the Electoral Act 2022 and based on the “doctrine of legitimate expectation”.

NewsOrient reports that the Presidential Election Petition Tribunal on the 6th of September, 2023 upheld the declaration of Asiwaju Bola Ahmed Tinubu as the winner of the 2023 Presidential Election.

We also report that Alhaji Atiku Abubakar, a former Vice President of Nigeria, described the Tribunal’s Judgement as “a grave miscarriage of justice.
