Case Seeking Buhari’s Sack Is Frivolous, Baseless, Abuse Of Court Process, Says High Court
A Federal High Court in Abuja on Monday dismissed the suit by a former Presidential Candidate of Hope Democratic Party, Chief Ambrose Owuru, which sought, among others, that President Muhammadu Buhari should be sacked and made to refund all the salaries, emoluments and security votes he had collected as Nigeria’s President.
Dismissing the case, Justice Inyang Ekwo of the Federal High Court described it as “frivolous’ and an “affront to the supremacy of the Supreme Court of Nigeria.”
Among the grounds on which the learned Justice dismissed the case were: that the suit constituted a gross abuse of court process; that it was statute barred; that it constituted an affront to the supremacy of the Supreme Court of Nigeria and that the suit was baseless and frivolous.
It has been reported earlier that Owuru instituted the legal action against Buhari and the Independent National Electoral Commission (INEC), seeking among other reliefs: “the court to determine the legality or otherwise of the decision by INEC in 2019 during which it postponed the election from February 16 to March 23.”
Owuru had alleged that “INEC acted against the constitution in illegal and unlawful ways and manners the presidential poll was shifted and the declaration of Muhammadu Buhari as the winner of the unlawful act should be declared null and void and of no effect.”
He prayed the court to remove Buhari and declare him (Owuru) as “the authentic President,” adding that President Buhari “should be compelled to refund all monies he collected as salaries, emoluments and security votes.”
