Deputy Speaker Kalu’s Certificate Discrepancy Allegation: LPDC Dismisses Complaint For Being Fundamentally Flawed

The Legal Practitioners Disciplinary Committee (LPDC) has dismissed a complaint filed against the Deputy Speaker of the House of Representatives, Rt. Hon Benjamin Kalu, alleging that his Law School Qualifying Certificate and his subsequent enrollment as a legal practitioner at the Supreme Court of Nigeria were fraudulently obtained.
LPDC, a legal practice regulatory and disciplinary body in Nigeria, threw the complaint out on the ground that the “petition was fundamentally flawed both procedurally and substantively.”
The Deputy Speaker Kalu was accused of participating in the National Youth Service Corps, NYSC, scheme at the same time he attended the Nigerian Law School, in violation of both the NYSC Act and the rules and regulations guiding Nigerian Law School attendance as a student.
LPDC panel that handled the matter in a certified true copy of its opinion on Wednesday, signed by a Senior Member, Umeh Kalu SAN, held that “the allegations bordering on NYSC participation, Nigerian Law School training, and enrollment at the Supreme Court fall entirely outside the LPDC’s jurisdiction.”
The legal practice regulatory body therefore dismissed the complaint “for being fundamentally flawed both procedurally and substantively.”
The panel noted that the “Statement of Facts was erroneously addressed to the Chairman of the Legal Practitioners’ Privileges Committee rather than the Chairman of the LPDC, as required under Rule 4 of the LPDC Rules, 2020.
“While the panel chose to overlook this error, it could not rescue the complaint on merit,” the panel said.
The LPDC explained further that it is established solely to regulate the professional conduct of enrolled legal practitioners in the discharge of their duties to the public, as provided under Section 10 of the Legal Practitioners Act.
NewsOrient recalls that the complaint against Hon Benjamin Kalu was brought by Barrister John Martins. The Learned Counsel alleged that Deputy Speaker Benjamin Kalu, formerly known as Benjamin Okezie Osisiogu before he made a legal name change, “had participated in the National Youth Service Corps (NYSC) scheme at the same time he attended the Nigerian Law School, an act John Martins Esq alleged was in violation of the NYSC Act and the rules and regulations guiding the Nigerian Law School attendance as a student.
