Gov Otti’s Libel Suit Against Chikamnayo: Defend Your Allegations, Court Tells Chikamnayo

The High Court of the Federal Capital Territory, Abuja, presided over by Hon. Justice J. E. Obanor, sitting at Court No. 26 at Jabi, Abuja on Monday; 15th day of July, 2026, has dismissed the challenge of the Defendant to the competence of the suit on ground that the Claimant did not personally sign FORM 6 (Certificate of Pre-Action Counselling by a Legal Practitioner).
The court in its considered ruling delivered on Friday; 24/7/2026 upheld the submission of George Ukaegbu, SAN, learned Senior Counsel to the Claimant to the effect that the lawsuit is very competent as the FORM 6 did not require a litigant to sign the said Form 6 but his Counsel only.
The court also agreed with the learned Senior Counsel for the Claimant that the deed of Arch Uche Uche, the agent to the Claimant who signed the originating process on behalf of the Claimant is valid in law as the law is trite that the act of an agent is deemed as the deed of the principal.
In dismissing the motion on notice marked as M/489/2026, according to the certified true copy of the ruling sighted by our judicial correspondent, the court pointed out that the witness of the Claimant deposed that he has the consent of the Claimant to file the lawsuit.
The learned trial Judge also stated that the outcome would have been different if the pre-action counseling certificate was not signed by Counsel to the Claimant.
The pre-action counselling certificate that accompanied the originating process before the court was duly signed by the learned senior counsel for the Claimant.
His lordship noted that technicality is no longer permitted to truncate the court doing substantial justice to disputes brought to the court.
The court adjourned hearing in the libel suit to November 4, 2026.
With this ruling, the Defendant should get set to defend the claims of the Claimant before the court.
