Supreme Court Reserves Verdict On Constitutionality Of EFCC

The Supreme Court of Nigeria on Tuesday reserved judgment in the suit filed by 16 state governments challenging the constitutionality of the laws establishing the Economic and Financial Crimes Commission (EFCC).

The apex court reserved it’s decision “to a date to be communicated to the parties.”

NewsOrient reports that some governors, whose states were alleged not to be part of the process that led to the establishment of the anti graft agency, had led their states to allege unconstitutionality of the laws that set up the anti corruption agency.

But EFCC and some critics of Nigerian political leaders argue that the governors challenging the constitutionality of the anti corruption agencies are doing so because they are currently feeling the heat of the works of the anti graft agencies.

The suit was originally filed by the Kogi State Government.

The other states that later joined in the suit marked: SC/CV/178/2023 include Ondo, Edo, Oyo, Ogun, Nasarawa, Kebbi, Katsina, Sokoto, Jigawa, Enugu, Benue, Anambra, Plateau, Cross-River and Niger.

But a report sourced from Channels Television said that at “the resumed hearing on Tuesday, Anambra, Ebonyi, and Adamawa states announced their decisions to withdraw their suits.”

Their suits were therefore struck out, accordingly, by the court.

It should be noted that since the suit over constitutionality of EFCC became public knowledge, there has been heated argument with regards to the true intentions of critics of EFCC.

But the Director of Public Affairs in the EFCC Wilson Uwujaren told Channels Television that the push for the scrapping of the agency is because governors are “feeling the heat” of the anti-graft body’s work.”

For now, Nigerians await eagerly for the final ruling of the apex court on the matter.
