Dr Sonny Ajala SAN, Counsel to Dr Alex Otti, the Governor of Abia State, has reacted to the claim of Sir Don Ubani that he has not been served any notice of the impending process. Dr Ajala described Sir Ubani’s claim as ‘false.’

He said Sir Ubani has been appropriately served notice through an online address he (Sir Don Ubani) provided both in his Facebook Wall and his online news website where the offensive article was published.

It would be recalled that Gov Alex Otti has, through his Counsel, served Don Ubani a notice to retract and render apology to Governor Alex Otti over a libelous publication he wrote and caused to be published against the person of Dr Alex Otti, the Governor of Abia State.

In the said online publication, where Don Ubani wrote derogatory and defamatory reports against Governor Otti, the writer and publisher of the offensive article gave his email address as sirdonubani@gmail.com.

So, reacting to the latest denial through an online publication, Dr Sonny Ajala SAN, counsel to Governor Alex Otti, said: ‘The news report by Don Ubani that he has not been served with the Demand Letter by Counsel to Dr. Alex Otti to retract his libelous online publication made on 26/9/2024 is False.

It should be recalled that the defamatory publication by Don Ubani on 26/9/2024 was made ONLINE wherein, he advertised his email as ‘sirdonubani@gmail.com.

“The Law in situs, FCT-Abuja, such as the [Cybercrimes (Prohibitions, Protections, etc) Act, 2015 as amended; the Evidence Act, 2023 as amended and the FCT High Civil Procedure Rules, 2018 together with binding judicial authorities] where our client-Gov. Alex Otti, OFR became aware of the libelous publication on 30/9/2024 recognize and authorize ELECTRONIC means of service of NOTICES.

Our letter dated October 2, 2024 in the last paragraph expressly stated that Don Ubani will be served via his email address ‘sirdonubani@gmail.com as indicated on his defamatory online publication of 26/9/2024.

Sequel to that, I, Dr. Sonny Ajala, SAN on October 2, 2024 served Don Ubani via his designated email at about 2:09pm the Demand Notice for Retraction, etc of the libelous publication as shown on the attached COPY of the SENT FOLDER of my email ‘deeplawconsulting@gmail.com.

Don Ubani should purge himself of the delusion of invincibility in the eyes of the law and desist further from his feeble denial of the reality and brace up for the consequences of his recklessness.

NewsOrient reports that the explanation of Dr Sonny Ajala SAN is coming as a reaction to Don Ubani’s denial of being served any notice.

In the online publication on Sunday, entitled “No Lawyer From Governor Otti Has Served Sir Don Ubani Any Notice.

Ubani claimed he is yet to be served any notice.

But Dr Ajala SAN said he has evidence of service of the notice to the online address which he, Sir Don Ubani, provided as his address, as required by law.
